Consolidated transvaginal mesh lawsuits have won important rulings in litigation.
Transvaginal mesh is a type of surgical mesh (much like a woven fabric)
inserted through the vagina. It is a product used to treat POP (Pelvic
Organ Prolapse). POP is a condition that affects the muscles and tissues
in women's pelvis as they age, making it difficult to support pelvic
organs like the bladder, bowel, and uterus, allowing one or more of these
organs to fall or drop into the vaginal wall.
Transvaginal means: “passing through or performed by way of the vagina.”
Mesh means: “a flexible netting of fine wire used in surgery especially
in the repair of large hernias and other body defects.”
Lawsuits involving transvaginal mesh products, have been consolidated before
federal Judge, Joseph R. Goodwin, in the U.S. District Court in the Southern
District of W. Virginia.
One ruling against the American Medical System ordered two former employees
to answer questions about claims the products are defective. The American
Medical System objected to the questioning.
Another ruling ordered Ethicon, Inc. to make a witness testify about the
company’s “Standard Operating Procedures” about five
separate products cited in the lawsuits. Ethicon, Inc. objected to the
“scope and breadth of the topic”, but were overruled.
The lawsuit allegations against transvaginal mesh products include the
following serious side effects:
- Organ Damage
- Vaginal Pain
According to the FDA (Food and Drug Administration) “Transvaginal
mesh failures are causing complications in patients such as erosion and
infection. Women who experience transvaginal mesh failure may need to
have numerous corrective surgeries.”
As a consumer and a patient, you have the right to trust that your medical
device is safe. Tragically, this is not always the case. When a pharmaceutical
company acts negligently, its actions can result in serious side effects.
Victims, however, may recoup damages through successful product liability
claims against the drug's maker.
